Senior Associate David Olander has written a debate article entitled “EU:s fria rörlighet vs alkoholmonopolet 1-0”. The article addresses a recent judgment by the Swedish Patent and Market Court in which Danish online wine retailer Vivino was successful in its defence against the Swedish retail monopoly Systembolaget’s motion to prohibit Vivino from serving Swedish customers. The case illustrates the inherent friction between the EU’s fundamental principle of free movement of goods and the Swedish State’s retail monopoly on alcoholic beverages, and if the judgment is upheld in the court of appeal, this precedent may facilitate other online retailers’ entry into the Swedish market.
